Notice of Meeting, Public Hearing and Intent to Adopt Ordinance
Public Improvement District 2007-1 in the Village of Angel Fire, New Mexico, hereby gives notice of a special Board of Directors meeting for Wednesday, May 6, 2009 at 1:30 p.m., at the Village of Angel Fire, Village Hall Meeting Room, 3388 Mountain View Boulevard in Angel Fire, New Mexico. At such meeting the Board of Directors will hold a public hearing concerning and will consider for adoption the Ordinance described below. Complete copies of the proposed Ordinance are available for public inspection during the normal and regular business hours of the District Secretary/Clerk, 3465 Mountain View Boulevard, Suite 14, Angel Fire, New Mexico.
The title of the proposed Ordinance is:

IN THE VILLAGE OF ANGEL FIRE, NEW MEXICO
ORDINANCE NO. 2009 1
AUTHORIZING THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT BY AND BETWEEN PUBLIC IMPROVEMENT DISTRICT 2007-1 IN THE VILLAGE OF ANGEL FIRE, NEW MEXICO (THE “GOVERNMENTAL UNIT”) AND THE NEW MEXICO FINANCE AUTHORITY, IN THE MAXIMUM PRINCIPAL AMOUNT OF $26,719,875 FOR THE PURPOSE OF FINANCING ROAD WORK, INSTALLATION OF PVC WATER LINES AND PVC SANITARY SEWER LINES FOR THE GOVERNMENTAL UNIT, PAYING A LOAN PROCESSING FEE AND FUNDING A LOAN AGREEMENT RESERVE ACCOUNT, AND EVIDENCING THE SPECIAL LIMITED OBLIGATION OF THE GOVERNMENTAL UNIT TO REPAY THE PRINCIPAL AMOUNT OF UP TO $26,719,875, TOGETHER WITH INTEREST THEREON; PROVIDING FOR MAXIMUM NET EFFECTIVE INTEREST RATES; PROVIDING FOR A SUPPLEMENTAL RESOLUTION TO BE SUBSEQUENTLY ADOPTED SPECIFYING DETAILS OF THE LOAN AGREEMENT, INCLUDING NET EFFECTIVE INTEREST RATES; PROVIDING FOR THE PAYMENT OF THE PRINCIPAL AND INTEREST DUE UNDER THE LOAN AGREEMENT SOLELY FROM THE GOVERNMENTAL UNIT’S SPECIAL LEVY ASSESSMENTS IMPOSED PURSUANT TO SECTION 5-11-1 ET SEQ., NMSA 1978, AND DISTRIBUTED TO THE GOVERNMENTAL UNIT BY THE COLFAX COUNTY, NEW MEXICO TREASURER TO BE PAID TO THE NEW MEXICO FINANCE AUTHORITY OR ITS ASSIGNS FOR THE PAYMENT OF PRINCIPAL AND INTEREST DUE ON THE LOAN AGREEMENT; RATIFYING ACTIONS HERETOFORE TAKEN; REPEALING ALL ACTION INCONSISTENT WITH THIS ORDINANCE; AND AUTHORIZING THE TAKING OF OTHER ACTIONS IN CONNECTION WITH THE EXECUTION AND DELIVERY OF THE LOAN AGREEMENT.
